Would a just society or government absolutely refrain from shaming or humiliating any of its members? "No," says this essay. It describes morally acceptable uses of shame, stigma and disgust as tools of social control in a decent (just) society. These uses involve criminal law, tort law, and informal social norms. The standard of moral acceptability proposed for determining the line is a version of perfectionistic prioritarian consequenstialism. From this standpoint, criticism is developed against Martha Nussbaum's view that to respect (...) the dignity of each person, society absolutely must refrain from certain ways of shaming and humiliating its members and rendering them objects of communal disgust. Is there a moral right to freedom of conscience? Should a legal right to freedom of conscience be established in each country on Earth? This essay argues for negative answers to both questions. The term freedom of conscience might refer to freedom of thought and the freedom of expression that sustains freedom of thought. In this sense we might affirm the right of each person to form individual opinions about the right and the good, about what we owe one another (...) by way of due consideration of others, and about what is worthy of pursuit in life, on the basis of free discussion of these matters. In the present discussion, these freedoms, important as they might be, are not under consideration. Let us assume freedom of thought and expression are secured. From the Introduction: This inquiry is concerned with the themes of praxis and action in four philosophic movements: Marxism, existentialism, pragmatism, and analytic philosophy. It is rare that these four movements are considered in a single inquiry, for there are profound differences of emphasis, focus, terminology, and approach represented by these styles of thought. Many philosophers believe that similarities among these movements are superficial and that a close examination of them will reveal only hopelessly unbridgeable cleavages. While respecting the genuine (...) fundamental differences of these movements, this inquiry is undertaken in the spirit of showing that there are important common themes and motifs in what first appears to be a chaotic babble of voices. Joel Feinberg was a brilliant philosopher whose work in social and moral philosophy is a legacy of excellent, even stunning achievement. Perhaps his most memorable achievement is his four-volume treatise on The Moral Limits of the Criminal Law, and perhaps the most striking jewel in this crowning achievement is his passionate and deeply insightful treatment of paternalism.1 Feinberg opposes Legal Paternalism, the doctrine that “it is always a good reason in support of a [criminal law] prohibition that it is necessary (...) to prevent harm (physical, psychological, or economic) to the actor himself.” Against this doctrine Feinberg asserts that when an agent’s sufficiently voluntary choice causes harm to herself or risk of harm to herself, this category of harm-to-self is never a good reason in support of criminal law prohibition of that type of conduct. Richard Rorty (1931–2007) was one of the most provocative and controversial philosophers of the past 50 years. He had a rare ability to combine sophisticated arguments with wit, charm, and humor. He was never dull – and he reached a wide public throughout the world. Originally trained in the history of philosophy and the grand tradition of metaphysics, he became fascinated with the linguistic turn in philosophy. During his early philosophical career, he wrote articles that were at the cutting (...) edge of analytic philosophy. He developed a new approach to the mind-body problem and raised troubling questions about the viability of the conceptual analysis of ordinary language. Soon, he began to question what he called the “Kantian foundations” of analytic philosophy. In 1979, he published Philosophy and the Mirror of Nature, a book that became an immediate sensation. Rorty, employing ingenious arguments, questioned the basis of analytic philosophy, and more generally the very idea of systematic philosophy. He called into question the Descartes-Locke-Kant tradition and claimed that the metaphor of the “mirror of nature” had misled philosophers into thinking that the task of philosophy is to “get things right” by representing objective reality. In the mid-twentieth century, the analytic-continental split in philosophy became bitterly entrenched. Many Anglo-American philosophers were convinced that linguistic analytic philosophy is “the only game in town.” They disdained what they took to be the lack of clarity and argumentative rigor among continental thinkers. The “compliment” was returned by continental thinkers who thought that much of analytic philosophy was trivial and insignificant. Rorty employed clever analytic techniques to challenge the pretentions of analytic philosophy. Many of his professional colleagues were furious. At the same time, Rorty engaged thinkers like Sartre, Heidegger, Gadamer, Habermas, Derrida, and Foucault. This delighted aficionados of continental philosophy – although they frequently judged his interpretations of these thinkers to be distorted caricatures. Rorty was one of the rare philosophers who transcended the analytic-continental split. At the same time, Rorty increasingly identified himself with the American pragmatic tradition. He entitled his 1982 collection of essays, “Consequences of Pragmatism,” which included his famous 1979 presidential address to the American Philosophical Association: “‘Pragmatism’ is a vague, ambiguous, and overworked word. Nevertheless it names the glory of our country’s intellectual tradition. No other American writers have offered so radical suggestion for making our future different from the past, as have James and Dewey” (Rorty 1982, p. 160). Rorty helped to revive a serious interest in James and Dewey. In the Introduction to Philosophy and the Mirror of Nature, he declared that the three most important philosophers of the twentieth century were Wittgenstein, Heidegger, and Dewey. Analytic philosophers might agree about the importance of Wittgenstein; continental thinkers might acknowledge the importance of Heidegger; but virtually no professional philosopher (except devotees of Dewey) would have ranked Dewey with the other two. Rorty claimed that each of these three thinkers had originally sought to find a new way to make philosophy “foundational,” but they came to realize that their earlier work was self-deceptive and they spent the rest of their time warning us against the temptations to which they had succumbed. “Their later work is therapeutic rather than constructive, edifying rather than systematic, designed to make the reader question his own motives for philosophizing rather than supply him with a new philosophical program.” (Rorty 1979, pp. 5–6) Rorty acknowledged that Dewey lacked Wittgenstein’s “dialectical acuity” and Heidegger’s “historical learning,” but Dewey articulated a vision of a new type of society. “In his ideal society, culture is no longer dominated by the ideal of objective cognition but by that of aesthetic enhancement. In that culture, as he said, the arts and sciences would be the ‘unforced flowers of life.” (Rorty 1979, p. 13) This was also Rorty’s vision of a liberal utopia. He developed this vision in Contingency, Irony, and Solidarity, where the central figure becomes the liberal ironist. Whereas Philosophy and the Mirror and Nature was filled with brilliant (although controversial) arguments, Rorty now debunked the role of argument in philosophy. “On the view of philosophy which I am offering, philosophers should not be asked for arguments against, for example, the correspondence theory of truth or the idea of the ‘intrinsic nature of reality’.” (Rorty 1989, p. 8) He favored redescription rather than argument. “I am not going to offer arguments against the vocabulary I want to replace. Instead, I am going to try to make the vocabulary I favor look attractive by showing how it may redescribe a variety of topics.” (Rorty 1989, p. 9) Interesting philosophy is not really a matter of argument at all but rather “a contrast between an entrenched vocabulary which has become a nuisance and a half-formed vocabulary which vaguely promises great things” (Rorty 1989, p. 9). Rorty deflated what many philosophers took to be the central concerns of philosophy, the nature of truth, reality, objectivity, knowledge, and morality. He sought to replace the appeal to objectivity with the appeal of solidarity. He is famous for his slogan “Take care of freedom and truth will take care of itself” (Rorty 1989, p. 176). Even admirers of Philosophy and the Mirror of Nature were distressed by the radical turn of Contingency where he suggested that novels, journalism, and literary reflection might be more effective than philosophical argumentation in bringing about his liberal utopia. Some of his fiercest critics claimed that Rorty could no longer be taken seriously as a philosopher. Contingency was savagely criticized and ridiculed, so much so that Rorty was provoked to write his revealing and delightful autobiographical sketch, “Trotsky and the Wild Orchids.” “I am sometimes told, by critics from both ends of the political spectrum, that my views are so weird as to be merely frivolous. They suspect that I will say anything to get a gasp, that I am just amusing myself by contradicting everybody else. This hurts. So I have tried, in what follows, to say something about how I got into my present position—how I got into philosophy, and then found myself unable to use philosophy for the purpose I had originally in mind.” (Rorty 1999, p. 5) What follows is an account of how Rorty grew up in a family that was deeply committed to furthering social justice. (“Trotsky” is a synecdoche for social justice.) Rorty also tells of his early nerdish love of the wild orchids of New Jersey. (“Wild orchids” is the synecdoche for private pleasures.) When Rorty became interested in philosophy, he wanted to find some intellectual or esthetic framework that would hold reality and justice in a single vision – one that would integrate social justice and private idiosyncratic pleasures. He tells the story of his eventual discovery that there was no such overarching framework and his growing realization that there was no need for such a framework. As a public citizen, one can be deeply committed to advancing social justice and at the same time, as a private person, enjoy idiosyncratic pleasures. There is no need to reconcile or synthesize these two incommensurable dimensions of human life. (shrink)

Some theorists who accept the existence of global justice duties to alleviate the condition of distant needy strangers hold that these duties are significantly constrained by special ties to fellow countrymen. The patriotic priority thesis holds that morality requires the members of each nation-state to give priority to helping needy fellow compatriots over more needy distant strangers. Three arguments for constraint and patriotic priority are examined in this essay: an argument from fair play, one from coercion, another from coercion and (...) autonomy. RICHARD RORTY has written one of the most important and challenging books to be published by an American philosopher in the past few decades. Some will find it a deeply disturbing book while others will find it liberating and exhilarating—both, as we shall see, may be right and wrong. Not since James and Dewey have we had such a devastating critique of professional philosophy. But unlike James and Dewey, who thought that once the sterility and artificiality of professional—and indeed (...) much of modern philosophy since Descartes—had been exposed, there was an important job for philosophers to do; Rorty leaves us in a much more ambiguous and unsettled state. I will examine Rorty’s book from a variety of perspectives, beginning with a general overview and then moving to more finely meshed descriptions. My aim is not only to illuminate the power and subtlety of Rorty’s analysis and to show its inner unity, but to locate basic issues that are left unresolved. (shrink)

The central thesis of Souls Exist is since the idea of God has lost credibility in much of contemporary society, the idea of the soul has suffered a similar fate. In the modern world, the concept of soul is not a meaningful reality for most individuals. The author emphasizes the dehumanizing consequences for those who are not conscious of the existence of their soul and the need for its development. Discussion of the soul's importance is founded on existential realities, not (...) religious myths. The epigraph of Souls Exist is a quotation from St. Augustine in his capacity as a philosopher: "There are only two questions for philosophy; the soul and God." In Souls Exist, this short list is reduced to one. Souls Exist is a metaphysical work and assumes metaphysical consciousness on the part of the readers. The author is an independent philosopher; consequently, the orientation of his writing is neither religious nor academic, but free-spirited and subjective. The issues raised in this work are of great importance for contemporary culture. The initial edition of Souls Exist was published in 1988. Individual differences in emotional reactivity or affective style can be decomposed into more elementary constituents. Several separable of affective style are identified such as the threshold for reactivity, peak amplitude of response, the rise time to peak and the recovery time. latter two characteristics constitute components of affective chronometry The circuitry that underlies two fundamental forms of motivation and and withdrawal-related processes-is described. Attention to internal body sensations is practiced in most meditation traditions. Many traditions state that this practice results in increased awareness of internal body sensations, but scientific studies evaluating this claim are lacking. We predicted that experienced meditators would display performance superior to that of nonmeditators on heartbeat detection, a standard noninvasive measure of resting interoceptive awareness. We compared two groups of meditators (Tibetan Buddhist and Kundalini) to an age- and body mass index-matched group of nonmeditators. Contrary to our prediction, (...) we found no evidence that meditators were superior to nonmeditators in the heartbeat detection task, across several sessions and respiratory modulation conditions. Compared to nonmeditators, however, meditators consistently rated their interoceptive performance as superior and the difficulty of the task as easier. These results provide evidence against the notion that practicing attention to internal body sensations, a core feature of meditation, enhances the ability to sense the heartbeat at rest. (shrink)

A diversity of methods have been used to study cerebral asymmetries associated with emotion. Many different conceptual schemes have also been invoked to guide research on this topic. The purpose of this article is to survey the critical methodological and conceptual issues in this area of research. Research in this area must acknowledge the multi-componential nature of emotion. Asymmetries associated with the perception of emotional information and the posing of emotional expressions are not necessarily the same as those that accompany (...) the actual production of emotion. Asymmetries vary along the rostral/caudal plane both in their magnitude and direction, as well as in their functional significance. Research in this area must explicitly take this variable into account. Different measures of asymmetry do not reflect the same underlying process and so cannot be used interchangeably. In particular, behavioural measures which lack extensive localising validation, must be used with caution. Finally, the nature of the causal connection between alterations in asymmetric activation and emotion is not a simple one and extant data indicate that an asymmetric shift is not sufficient for the production of emotion. This fact has serious implications for the types of experimental designs that must be used to adequately test for relations between cerebral asymmetry and emotion. The article concludes with a discussion of some of the major outstanding questions that will occupy a central position in the future research agenda in this area. (shrink)

If an array of goods is for sale on a market, one’s wealth, the tradeable resources one owns, determines what one can purchase from this array. One’s income is the increment in wealth one acquires over a given period of time. In any society, we observe some people having more wealth and income, some less. At any given time, in some societies average wealth is greater than in others. Across time, we can observe societies becoming richer or poorer and showing (...) more or less equal distributions of wealth among their members. Does it matter from an ethical standpoint whether some people have more income and wealth than others? Does securing a more equal distribution of income and wealth either constitute the achievement of something that is intrinsically morally desirable or serve as a reliable means to the achievement of some intrinsic moral value? If we suppose that justice demands equalizing the income of wealth of persons in many circumstances, what principles of justice generate this demand? (shrink)

Numerous academic studies and reports indicate that as many as half of all students cheat on exams. Cheating on exams undermines the central purpose of a university, corrupts the meaning of grades as a measure of subject matter mastery, and significantly harms honest students. Although instructors are aware that many students cheat and they clearly oppose the behavior, they do little to punish cheaters. Accusing, prosecuting and convicting cheaters are time intensive, stressful and potentially costly activities for which faculty members (...) receive few rewards. In this paper, we derive an equation to estimate the benefit that can be gained by a student who copies on a multiple choice exam. We then propose an exam design that not only eliminates the benefit, but also proportionately punishes cheaters, with little to no cost to instructors. Moreover, the exam system we propose can allow an instructor to determine, with a high degree of certainty, the odds that any student seated anywhere in the classroom cheated on any part of the exam. A notable achievement of T.M. Scanlon's What We Owe to Each Other is its sustained critique of welfarist consequentialism. Consequentialism is the doctrine that one morally ought always to do an act, of the alternatives, that brings about a state of affairs that is no less good than any other one could bring about. Welfarism is the view that what makes a state of affairs better or worse is some increasing function of the welfare for persons realized in it.
